Our Real Estate lawyers have extensive experience managing zoning, subdivision, and other land use matters, including historic preservation, special permits and variance requests, zoning appeals and governmental grants and subsidies.
We also handle all other aspects of entitlement and construction permitting, construction and architectural contract negotiations, financing negotiations, condominium creation and conversions, and other related matters on behalf of our developer clients.
MAK also has comprehensive experience with the preparation and negotiation of documentation for construction. Notably, MAK’s founding partner, Michael A. Kelly is widely recognized for his expertise in permitting, development, and land use law. In his former position as general counsel for Cumberland Farm/Gulf Oil, Inc., Michael oversaw the permitting and construction process for several hundred gas stations and convenience stores from Maine to Florida.

A key part of MAK’s Real Estate practice is land use law – a combination of real estate, administrative, and, environmental law, in addition to litigation. Our Land Use practice focuses primarily on clients’ plans for the development or redevelopment of real estate – from new construction and alterations to commercial occupancy changes, property line changes, and site development activity, including land preservation and landscaping.
MAK is well known for its extensive experience dealing with municipalities in and around Rhode Island and Massachusetts. Our attorneys routinely appear before state, local, and federal governmental regulatory bodies – including zoning boards and planning boards – with the goal of obtaining land development approvals, special use permits, use variance, dimensional variance, and conditional use permits for our clients.
In addition, we frequently pursue and receive approval before city and town councils to obtain zone changes, amendments to comprehensive plans, road abandonment, and zoning ordinance amendments.

MAK’s Administrative Law practice aims to help clients achieve their business and personal goals while balancing the requirements of federal and state regulatory policies.
Specifically, our Administrative Law practice specializes in business and economic regulation, industry restructuring and deregulation, contracting and project development, and trade regulation – as well as legislative consultation and lobbying registration and reporting requirements.
The firm’s attorneys are well versed in the requirements of the Administrative Procedure Act (APA), which governs the way in which federal administrative agencies can propose and establish regulations. Our experience with the APA spans administrative hearings and adjudication, administrative investigations, administrative officers and agents, administrative rule making, licensing, and regulatory enforcement.
